TERMS & CONDITIONS - THE BASICS

In order to rent a Scooter, you must have an identification and address proof. NO CASH PAYMENT shall be made to any person at any point by the Rider in relation to the Rental Plan and related services as mentioned herein. Before you make any payments, please read this agreement carefully. It sets forth the legally binding terms and conditions for your use of the Services (as defined below), will affect your legal rights, and will limit or eliminate your ability to bring future legal actions. By accepting the terms and conditions, you will be legally bound to follow all the below-mentioned terms and conditions during your relationship with Flex EV Mobility Services Pvt Ltd (FLEX Electric). Without your acceptance of the terms and conditions, Flex EV Mobility Services Pvt Ltd (FLEX) shall not be able to give on Rent any Scooter. If you disagree with any of the terms of this agreement, please refrain from renting any Scooter.

PREAMBLE

WHEREAS Flex EV Mobility Services Pvt Ltd (FLEX Electric) is in the business of providing e-bikes, e-scooters, and two-wheelers on Rent and last-mile delivery services.

WHEREAS the Rider is eager to avail the services and take on Rent a Scooter and has filled the online form containing his address and contact details, and uploaded or agreed to provide identity proof and other required details. The Rider has selected the Scooter (hereinafter referred to as the "Scooter") by selecting the appropriate column in the Booking form. The Rider has chosen the expected Rental Plan on the App and understood the tariffs and rates applicable. The Vehicle covers insurance for the risks listed in the Insurance policy taken by the company.

This Agreement, together with all updates, additional terms, and all of our rules and policies collectively constitute this "Agreement" between You and Us (FLEX Electric). In consideration of your use of any of the Services provided by BycyShare Technologies Private Limited ("FLEX Electric"/"we"/"our"/"us"), FLEX Electric requires that you ("Rider"/"you"/"your") agree to all terms and conditions in this FLEX Electric Rental Agreement ("Agreement"). We reserve the right, in our sole discretion, to unilaterally amend, modify, or otherwise change this Agreement at any time. We will post a revised version of this Agreement on our website or mobile application (collectively, the "App"). Your continuing use of the Services after a revised version of this Agreement is posted constitutes your agreement to such revised Agreement. If you do not agree with the revised version of the Agreement, you must stop using our Services. You agree to carefully review this Agreement on the App periodically and agree that each time you rent a Scooter (as defined below), the then-current version of the Agreement as posted on the App will apply.

1. SERVICES GENERALLY

The "Services" provided by FLEX Electric under the Rental Plan (Plan as mentioned on the App) are composed of several elements, including:

  1. Automated self-serve rental system of FLEX Electric scooters ("Scooter" or "Scooters") with 100 km running capacity on a single charge (subject to best use and under best circumstances) and 2 batteries.

  2. Discretionary charging of the Scooter by Rider through the FLEX Electric charger.

  3. Running/maintenance repair and services as per terms mentioned herein.

  4. 24/7 Roadside Assistance.

  5. Other related equipment, personnel, services, and information provided or made available by FLEX Electric.

The Services are provided by FLEX Electric only within the city or location in which you rent the Scooter ("Location"). You agree and acknowledge that you are renting the Scooter and that Ownership and Title of the Scooter remain with FLEX Electric at all times. You shall only have the right to use the scooter under the brand name of FLEX Electric subject to these terms mentioned herein; you further agree and acknowledge that you are the sole renter and are solely responsible for compliance with all terms and conditions contained herein.

You understand that when you rent a Scooter, that Scooter shall be used by you only, and you shall not allow other users to use the Scooter that you have rented. The Scooters shall be rented by individuals at least 18 years of age only and subject to local laws. If you falsify or misrepresent your age, you and your legal guardian shall bear full responsibility for all Claims (as defined below) related to such misrepresentation. The Rental Plan Services are subject to availability of Scooters and fulfillment of these terms.

2. FEES

We agree to rent to you, and you agree to rent from us, Scooters through our Services subject to these terms and conditions at a Rent in accordance with the Rental Plan plus GST as set forth on our Site or Application, which are subject to applicable sales taxes and other local government charges that may be modified from time to time at our sole discretion. The rates may vary between Locations and will be provided through the App when you start your rental.

The Rider shall pay the Total Rent Fee (as described in Clause 4 below) for the Rental Period as per the Rental Plan at the time of renting the Scooter. The Rider shall deposit an amount as Security Deposit with us at that time.

Any payment for Rent Fee, Security Deposit, service cost, mechanic charge, repair cost, etc., in relation to this Service shall be payable through FLEX Wallet (FLEX Wallet is a secure digital/mobile wallet for multiple purposes within our App). It functions like digital cash for consumer payments within our application framework while maintaining a minimum balance as mentioned in it.

During the Rental Period, Rider shall maintain a minimum balance of pre-allocated Security Deposit in their FLEX wallet at all times. If they fail to do so, FLEX Electric reserves the right to terminate the rental period immediately and lock the Scooter due to non-maintenance of minimum balance. All amounts due will be charged to your FLEX Wallet. In case credit or debit card charges are not paid, other collection procedures may be employed.

You agree to pay all costs of collection if amounts owed are not paid when due.

If your FLEX Wallet balance goes below Security Deposit amount without topping up again promptly, we reserve our right to automatically lock your Scooter.

3. RIDER'S REPRESENTATIONS AND WARRANTIES

You understand that Services provide time-bound access to Scooters; thus your use shall not exceed your paid duration under Rental Plan as informed at rental time. Any Scooters not returned within 2 hours after completing Rental Period will be deemed stolen or lost; hence FLEX Electric has rights to lock them from backend.

Rider holds absolute liability for care until returning it back; if damaged/stolen/impounded/lost during Rental Period then full recovery responsibility lies with you; if non-recovered then compensation is due for full cost including accessories involved.

You must report damage/stolen/lost immediately via App; compensations apply for damages excluding normal wear/tear based on repair costs determined solely by us/affiliates upon discovery.

You authorize us charging fees incurred via your FLEX Wallet/credit/debit card; disputes must be raised within ten days upon receiving statements showing disputed charges.

Your Use of Scooter

This Section applies geographic restrictions regarding rental/use; operation/use by minors is expressly prohibited—if allowed through account activation then liability falls entirely upon responsible party concerning misuse/consequences arising thereof.

4. SUBSCRIPTIONS FOR RENTALS

The Rental Fee (or subscription fee) is charged when choosing a subscription plan on App; we reserve rights changing fees periodically without price protection/refunds during price drops/promotions offered elsewhere.

We bill automatically at subscription term's beginning; if available in area then renting is possible based on agreed schedule published within Application upon payment completion (Rental Fee + Security Deposit).

Subscriptions can cover one scooter at once; additional batteries incur extra fees listed within App alongside offering various plans including free trials/discounted pricing/special third-party promotions having different/additional disclosed terms upon signup.

We reserve rights modifying/terminating/amending subscriptions anytime after communicating changes; cancellations can occur without reason but refunds won’t occur mid-term forfeiting prior payments made towards rentals.

Security Deposit refundable subject deductions related service costs/mechanic charges/repair costs etc., per Agreement's terms.

5. RENTAL INSPECTION USE OF SCOOTER PLAN RENEWAL AND RETURN OF SCOOTER

Rider acknowledges inspecting/approving Scooters satisfactorily before taking them; ensuring due care while responsible for loss/damage due theft/mysterious disappearance beyond ordinary wear/tear remains their obligation throughout rental duration.

Before using Scooters basic safety inspections should include checking:

  • Trueness of wheels

  • Safe operation brakes/lights

  • Good condition frame

  • Sufficient battery charge power

  • Signs damage/unusual wear/mechanical problems

Rider agrees not riding Scooters if issues arise immediately notifying FLEX Advisors regarding defects discovered during rentals—App features triangle button enabling defect reporting prompting post-rental reporting too.

If leaving unattended securing/locking through App against theft is mandatory—returning requires inspection confirming condition/equipments match initial state before deciding deductions from Security Deposit based on normal wear/tear criteria accordingly.

At end-of-Rental Period returning Scooters along accessories/equipments provided initially occurs at predefined FLEX Hub specific designated pickup locations unless otherwise permitted incurring additional fees deducted from wallets accordingly—referencing App requirements returning compliance necessary ensures proper procedures followed throughout process.

Failure returning immediately post-Rental Period leads locking down process initiated backend unlocking only upon requests intending returns specified locations—charges double daily rates apply until returned accordingly confirming compliance established throughout rentals conducted properly ensuring all parties involved adhere agreements signed thus maintaining accountability across board ensuring satisfaction achieved mutually beneficially!

WHAT TO INCLUDE IN THE T&C DOCUMENT

Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much much more.
